Statutory rape is.. statutory. That means intent is not an element of the crime, prosecution only has to prove the bad act actually occurred. That's also why "I thought she was legal" is never a tenable defense unless the law in that jurisdiction specifically allows for it; it's a defense which attacks mens rea (guilty mind / intent).Will it matter with statutory rape? Maybe they both come out of it with charges?
