Yep, they can. Think OJ Simpson. He beat the criminal charges, but was sued by the families and lost the civil trial.

I’d argue the wrinkle might be different here, since he’s going with a self defense argument, which is also a defense to the civil side of things as well. If he walks on self defense, it would be very hard, if not legally impossible to defeat the self defense argument in the civil world.

Judge just dismissed the weapons charge prior to closing arguments. That's an incredibly good sign that the jury won't even be able to deliberate on that one.

Pointing it at people is but there's no witness testimony Kyle was doing that and no video evidence Kyle was doing that.

If the jury finds that Kyle waived his right to self defense by acting in a provocative manner (as defined by the law) I still don't think that opens up the murder charges. The elements of that crime are just not there. It does open up whatever basket of manslaughter/assault with a deadly weapon shit they're tacking on at the end.

It seemed likely the jury would stick him with a lesser charge plus the weapons charge but without the weapons charge I think his odds of walking entirely go up?

When did the Media turn on Trump? "Drain the Swamp". The Media has been in the tank for more Government and the State since the 1960's. Every Democrat President has had sworn evidence of worse crimes than Watergate in brought in Congress and the media has just stood by and either played it neutral or actively defended them; meanwhile a Fake Conspiracy was voted on as impeachment by a hostile House, then another for something that the Current President actually did.

And fuck that, the Iraqis themselves thought they had WMDs. Whatever they did have went to Syria. Bush's idea wasn't bad (to create an Arab democracy) but with Iran next door and opportunistic Dems waiting to pounce, it was a set-up much like Vietnam. Utopian-esque dreams of nation-building require a level of commitment, unity and opportunity that wasn't present geopolitically or at home in that timeframe. While it wasn't nearly as costly in lives, it was just as costly in domestic political division from which we have never recovered and have in fact devolved. Meanwhile, we finally won in Iraq and like in Vietnam, the Democrats, this time Obama and Commander Splashdown, gave it away.

If you're gonna make that argument, it gives you a casus belli for invading anybody you want. Invade Syria, don't find WMDs there either? They must have been moved to Iran. Invade Iran, don't find anything there? They must have been moved to Pakistan. At some point you have to ask yourself what's actually worth killing our troops over. In the early 2010's I ran a bunch of fundraisers for wounded veterans and I saw some pretty gruesome shit as far as injuries go. I'd argue none of that "WMD" bullshit was worth killing/maiming guys who signed up to protect us from actual threats.

No. Typically the attorneys will draft them and swap drafts back and forth. Typically this happens pre-trial even. It only goes to the judge to decide on instructions if the attorneys can't come to an agreement.
