The investigator's report offered no conclusion as to whether John Doe had forced Sandra Jones to engage in oral sex. The investigator found that John Doe's account was consistent and credible insofar as he stated that he had experienced a total blackout and could recall nothing of his evening with Sandra Jones.
The hearing board itself, again due to the victims own testimony, found it credible he was blacked out drunk.
The decision indicated that the hearing board found it "credible" that John Doe was "blacked out" but that "eing intoxicated or impaired by drugs or alcohol is never an excuse."Id.at p. 2.The hearing board found Sandra Jones's account of withdrawing consent during the sexual act to be "credible and supported by a preponderance of the evidence.
This is precisely how the victim describes the sexual encounter.
Sandra Jones testified that although she and plaintiff had engaged in consensual oral sex, at some point during the event she no longer wished to continue and told him to stop, but he went on nonetheless, holding her head until he finished.See Ex. 3 at 43. She said that the assault was "terrifying and traumatic for me and took me a long time to name, let alone tell anyone about it."
In addition she was asked about electronic communication, and found to have outright lied and fabricated what she said after (Not admitting the communication where she confessed it was a consensual encounter.)...But the troubling part here is this college finds it to be sexual assault if drinking pushes someone beyond a reasonable standard of decision making....Now, this board admitted the male student was black out drunk, which is well beyond that standard; and by their own definition this means the male was raped.
I mean, the big thing here is drop the he-said and she-said bullshit for second. The victim/accuser don't matter for one second--just focus on what the college board is saying. The male is black out drunk (They said that) and yet is still responsible when the (Sober) woman initiates a sexual act.
