People were talking about Erdogan and the comedian now being sued for "Schm?hkritik".
The comedian is being sued not for satire, but for "Schm?hkritik". It means that the aim of his poem was only in degrading the person and the real person Erdogan was not visible in it. The poem was basically a hilarious chain of insults, like goatfucker, child porn watcher, impotent and many more. This is not allowed in Germany. The law they use to sue B?hnermann is a special case. Since Erdogan is Dickchief of Turkey our prosecutors only get active, if that person/governemnt asks for it.
To better understand all of this, one can look at another song aimed at Erdogan. A few weeks earlier a satire show aired a song about Erdogan, mainly criticising his jailing of media not in bed with him. It was not as over the top and it was related to actual actions by the turkish government and Erdogan and Erdogan himself was not insulted in a way, that has no evidence whatsoever (He probably fucks goats in his private time anyway). Erdogan made a big fuss about it, but there were no consequences except showing once again what a spineless twat Merkel is.
So, our courts have to define what Satire is and therefor allowed and what goes beyond Satire into Schm?hkritik, which is not allowed, but needs the affected person to become active.
Personally I wish we would allow more especially regarding public persons. I understand why we have a closer look on what we say about other persons, because our constitution was created after the Holocaust, but still. Hopefully B?hnemann will be not guilty. His piece was rather clever and maybe we stop policing every little shit somebody says online or on TV/print.
