I was wondering though.. technically Saul didn't 'falsify' evidence, cause all the previous tapes were 'stolen'. He just showed them a new video of the same content that the dude makes for his 'patron'.

edit: or rather, that's how he could have played it off if asked. If he specifically said one of the old tapes were recovered, and then showed them that, yes he was falsifying evidence.

My impression was that he was passing it off as one of the old tapes to back up the story.

Still pretty iffy. The entire case was based on his baseball cards, the tapes were never reported stolen and the police had no actual case relating to them

That was the point, they weren't reported stolen because they were private and hidden and the matter was being handled personally. Or that was the lie he sold the police as to what was in the hidden stash they were so interested in.

I enjoyed the scene, but it was kinda stupid, funny but stupid. The guy acts nervous around cops and has a hole in his floorboards. Would the cops really go after him past the first interview? Couldn't Saul just be like 'fuck off you have nothing.' I guess it's better to have him completely off the police's radar since Mike is involved and he might want to keep dealing drugs but the whole scene seemed a little excessive in order to get some laughs.

It seems unlikely that the cops would have the resources to go on a complete hunch. There's no evidence of anything illegal.

It's one of those weird Hollywood things to add drama, but completely fictional for the real world.

They saw an otherwise boring guy have a ridiculously expensive and gaudy Hummer when responding to a burglary call where none of the normal things were missing that would be taken if it was a random job. It seemed like a targeted hit by professionals. Then, they see the junk strewn about is cleared by the couch, check it out, finding a pretty deliberate hiding place that was either found by the professional robbers or its contents moved or checked on before police got to the scene. So they make a few phone calls to the very nervous and bumbling idiot in question. Because, as very clearly explained by Mike, a former police officer who pegged exactly what was going on, they correctly suspected something was fishy and hoped they could call in said bumbling buffoon and get him to crack under the pressure, leading them to again what by all appearances wasn't a random meth-head robbery but something done by professionals of one sort or another. It's not like they started a task force or staked out the place for weeks on some random, unsupported hunch. Not exactly exaggerated Hollywood fantasy in any of that.

"Evidence" isn't "evidence" until a crime has been committed. If there are no charges (Indictment, criminal accusation, etc), there is no "evidence." Saul and his client are free to make all the videos they want with relative impunity up until the point that charges are levied. There are other crimes associated with obstructing an investigation, but not "falsifying evidence."

Yes, I recommend everyone, especially lawyers, do this. If the police start investigating, lie to them and produce false not-necessarily-evidence-yet to hinder the investigation and see how far arguing the semantics of when evidence becomes evidence will get you.

Except that's not at all similar to what happened in the show. I'm gonna go ahead and say items removed from a hiding place accessed after a house was tossed in a case where the cops are called out by a victim very nervous who inexplicably has an expensive Hummer in the driveway is just a little bit more connected than reporting your car stolen and police asking if you've ever hit your wife.
