I dont know about this. I feel similar to how I do about the nut jobs that shoot up the schools, in that the less of a celebrity they are made out to be the better. Let them be obscure.
I think the scenario that's sticking now was that he ran out of ammunition and ran straight at the cops, they tacked him and were in the process of handcuffing him, when the younger guy drove straight at the whole pile of cops/brother. Cops jumped out of the way and the brother got run over. So it sounds like he was still quite alive, though probably highly wounded since the medical report mentioned gunshots.
It doesn't matter what the intent was. If you kill someone, intentionally or not, while you were already committed a felony, it's second degree murder. I'm pretty sure that murdering a cop, being involved in a high speed police chase, randomly throwing explosives out onto a street, and then getting involved in a shootout with police, counts as a felony.
So whats the body count cut off for losing vs. retaining constitutional rights?
What if they do it with a gun? Is it only bombs you have a problem with? Or is that they are religious fundamentalist? What if a christian tries to murder 100's of people with a gun?
From what we've been told of what happened, I think it's unlikely there's a mastermind behind this attack. No-one claimed responsibility and everything about it seems... amateurish. Hell, according to CNN they told the person whose car they jacked that they were the marathon bombers, and having committed a terrorist atrocity a couple of days before, they let the person walk away and call the police and didn't realise he'd left his cellphone in the car so they were being tracked.
Really bad idea. Some of these crazies are doing this specifically to try and get publicity for their cause. A public trial would possibly give him a stage to present his grievances and certainly would be a huge spectacle. Let him get a fair trial in private without any circus atmosphere.
They do. The felony murder rule is on the books in most states but not all. It also varies whether it counts as first or second degree murder.
So that whole "presumption of innocence" thing goes right out the door, right? Just snatch up the first Muslim who Fox News puts at the scene and ship him off to a CIA black site for the rest of his short life? God damn man. Just god damn.
