The employer is supposed to make up the difference IF the server doesn't receive enough gratuity compensation (at least in NY State). The employee and/or employer usually sign statements effectively claiming the servers make "x" amount in tips. The little secret is servers actually do very well with cash tips because most of them only pay taxes on minimum wage, but take in a lot more.
