He mentioned 3rd party shouldn't be able to be paid to provide timed exclusivity and specifically mentioned "shouldn't exist outside of 1st party".

In your example, if you make the app, that is 1st party and you choose.

I agree on both points. I also think it should be illegal for all brands to be able to choose an exclusive partner. IE: EA buying all rights to Star Wars or NFL properties for a decade or 5. Look what happens to quality as a result.

Why not? Why should the 3rd party not be able to secure better terms for themselves? Competition between 2 other companies should not be their problem.

And the brand thing would be no different from telling the athletes they can't have endorsements because that's not fair to the companies they're not endorsing.
