the prosecution implied anything they could get away with, doesnt mean any of it had any kind of merit to it. they are still falling back on avery's 18 year incarceration as some kind of evidence that he is a sexual predator. the same incarceration he was falsely convicted of by the same people who convicted him this time.
Part of the prosecution's angle is that he was sexually infatuated with her. Whether you believe that or not is one thing, but the motive being put forth was sexual assault, which needs no motive beyond that (Unless you're a 3rd wave feminist, in which case the motive was his desire to assert his dominance over her and it was all about control and a show of power... and the patriarchy... But I wouldn't ever accuse you of such a thing

yes, but think about it, all the people you have been sexually interested in, how many of them did you rape? it only looks guilty for avery because he had already been convicted of a sex crime and that was another case of railroading by the same people saying he was sexually infatuated with TH. you dont see anything ridiculous about that?

i realize what you're saying, but what i am saying is that of course they are saying he wanted to rape TH or that he did. because he had already been convicted of rape and so rape is his MO. if they had railroaded him on a string of robbery charges, guess what they would have said his motive was for killing her? yeah she had phat l00tz.

I can see telling the cops what they want to hear in confusion of a 4 hour interigation. But admiting to your mother, when you think you are in a private conversation a crime you did not commit, and not just any crime a rape and a murder to is what i have a hard time with. A normal human reaction is to plead with your mother that you did not do it. What other evidence was there vs Brendan?
I admit to not watching the last episode before i made this statment, now in the full context i retract it and take my deserved internet lumps.

This is actually a really valid point. We have irrefutable proof as presented at trial that Avery answered the door in a towel and requested her specifically, which certainly proves infatuation, which would lead to stalking, which is logically going to result in rape, torture, and murder! You know, with all the irrefutable proof presented that that's exactly what happened. It's not like the investigators and/or DA can just tell a half baked story and have it catch on in the media and become a talking point locally. That's just not how things work. They went with the rape allegations because of all the irrefutable proof of it. That's where the evidence led the investigation. It's not like they just put the story out there and then said things to back it up. It was because of EVIDENCE, like him answering the door in a towel and how he specifically requested she come out to take the pictures. Pretty sure Jive is right on this one. It's pretty obvious the evidence indicates he raped her. I mean, answering the door in a towel. That isn't at all disputed. That's a fact! And it's the first step toward raping, torturing, murdering someone!

I actually don't think there is any evidence of the towel thing, and I believe that idea was excluded at trial. If this monkeydick judge excluded it, you know it must be like totally provably false otherwise he'd have allowed it.

To be fair the poofy sex toy leg irons don't prove he didn't fantasize about rape torture. That could all have been part of the fantasy.

However, it's just as likely he actually did buy them for he and his girlfriend. The guy is a sexual deviant, but of course that does not make him a murderer or a rapist.

This documentary leaves a bit of a sour taste in my mouth. I am of the thought that he did it and there was simply not enough physical evidence so they falsified evidence for a slam dunk (the key, maybe the blood, the bullet, maybe even moving the body behind his house instead of the barrel) - i think without these pieces it would be reasonable to believe based on his past that he was innocent. Things like his sweat being found on the hood/key certainly make me question the thought of a complete setup, it's just not feasible they had that to plant. I would guess she was killed somewhere else, burned in the barrel and then moved behind his house. She was thrown in the car to transport her from the kill site to Avery's house and then the car was ditched and then moved back by Colbourn(sp) - in reference to his strange phone call.

Just my thoughts anyways. No one truly knows if Avery is innocent besides Avery himself.

Ok just so we're clear, there's no DNA in sweat itself. There may be DNA in skin cells which come along with sweat if you rub it off on something. So with them saying "sweat DNA" it makes it sound like they positively identified sweat and got a sample of it. They did not. They just swabbed the key/hood and tested it for DNA.

If someone took your underwear and rubbed the key on it vigorously then tossed it on the floor, it'd have your DNA on it.

I wasn't talking about the leg irons. I was talking about all the previous run ins with the law regarding his sexual behavior. I may be mistaken but I thought they actually did have solid evidence about him doing things like flashing passing motorists and such.

No that all came from the cousin that he confronted on the road about "spreading rumors" and in her deposition (first episode I believe?) she recanted most of that.

The hood evidence was tainted anyway. The tech gathering the evidence did not change gloves between swabbing for DNA in his actual trailer (which very easily could have gotten SA's DNA on them) and swabbing the car.

I know the cousin recanted some of it but I thought other, non relative women reported similar incidents. Maybe I'm just making shit up in my head at this point though.

Yeah I get that. I just figured there was some dead skin cells along with the sweat.
