Wouldn't gamers also be bidding against the scalpers, as well?

If they're competitively bidding, and gamers bid up to the limit they're willing to spend, I'd think either the scalpers go higher and are then stuck with product they can't resell because they bid too high, or gamers bid higher than the scalpers and the scalpers just lose.
I would just make bots that outbid everyone and then resell them. That's next level scalpchad.

I guess I don't get why that's an issue. Do it as "All sales final, except for manufacturing/design defect". Someone wanting to return product "because silly reasons" is their own issue, not the vendors. Then charge a restock fee if you're so inclined. So if you try to pull some buying/returning asshattery, that's on you. But return a card because it doesn't work...manufacturer verifies it's FUBAR...give customer a full refund.

Until stock is gone and people are waiting for more "official auctions" at which point supply is 0 and demand is still there. Creating a market for the scalpers to capitalize on with what they bought at official auction. And as Kriptini said, they could just return it if they were wrong about what people were willing to spend.

So what's the problem here? People didn't bid in the original auction and scalpers snapped all of that stock up? Whose fault is that, then?

Do releases in waves. First wave will have higher demand. The people who want that shit bad enough will be on top of it, and will bid harder for earlier releases. Let the average consumer get in on wave 2 or 3 (or if they're stupid, buy stock from the scalpers, because they're stupid).

If you bid in the initial auction and you bid too low to get a card...I dunno what to tell you, but it's not the auction systems fault.

So I have a Zotac 3090 coming to me on Monday, but I bought it before realizing that I don't really want it. As good ol' Mr. Goldbum said, I was so wrapped up in whether I could, I never stopped to think about whether I should!

So now I'm conflicted at selling it for what I paid, like on Hardware swap or something, or trying to trade it for a 3080 + cash? Not sure what to do with it.

Humans are impatient Tuco, if someone wants the item and its available on eBay but no "official" auctions are happening (and the auctions are swarmed by bots) there will always be people willing to pay higher prices for immediate gratification. Your auction idea does not solve this. You're missing the point of the problem. Not enough supply. Auctions would have the same issues as the current online marketplaces do. It also doesn't solve the price gouging problem. In fact it would make it worse.
Sure, but instead of scalpers using bots to outwork consumers to pay NVIDIA/BestBuy/Newegg/Whomever $700 for an RTX3080 to resell it for $1300, they'll use bots (???) to pay NVIDIA et all $1300 and resale it for hopefully somewhere north of that.

The return policy question is irrelevant because unless NVIDIA et all totally botch the auction system, the profit margin will be too low to make it worth it.

Hardware Unboxed is pretty retarded. They hand-waved away benchmarking ray-tracing on a whim. They claim that not enough games include ray-tracing graphics despite the fact that Control, Deliver Us The Moon, COD Modern Warfare, COD Cold War, Fortnite, Metro Exodus, Minecraft, Quake II, Shadow of the Tomb Raider, Watch Dogs Legion, WoW Shadowlands, and now Cyberpunk 2077 support ray-tracing graphics.

I'll still watch Hardware Unboxed for their monitor reviews but I won't watch them for the GPU reviews anymore. I used to think they were respectable but they're suspect now.

This isn't smart on Nvidia's end right now. They have some comp from AMD. Bad release of 3 series, lost the value war...and they want to now ban one of the most popular video card reviewers from receiving FE cards?

I agree that they shouldn't let arbitrary reasons guide the results they provide, but I think RT being the hill Nvidia wants to die on is very strange. If Cyberpunk proved anything it was that RT is not ready for the spotlight this generation (although I think it also proved that DLSS 2.0 is not just ready for the spotlight, but is the actual killer feature of the new cards). Additionally, this board is full of people at the bleeding edge of computer hardware. That does not reflect the vast, overwhelming majority of computer gamers who generally still only care about pure rasterization.

I personally hope that Nvidia fucks up as royally as possible and is forced to reduce the price of their cards, thus bringing video card prices back to somewhere that is reasonable for consumers. Otherwise, I just want there to be competition in the space again and it is nice that AMD has gotten Nvidia butthurt enough to start doing petty things like this for no real gain.

So I chatted with a best buy pajeet on the website this morning to see if they could give me a shipping tracking number for my 3060 so I be sure it actually exists. He proceeds to tell me that the item was "lost in transit". He then tells me "not to worry. I will help you with the best options". Those options being to cancel the order or wait for a reship. I closed the chat without further comment, confident in the knowledge that Praheet Jindal had no fucking clue what he was talking about.

Got the ready for pickup email a couple hours later and have it at home now. Moral of the story is to never even try to use chat customer service options.
