Let me get it straight. You don't want the government data mining because some people might be guilty of bad things.....
Data mining isn't about finding facts, it's about exposing trends based on a multitude of factors WITHOUT UNDERSTANDING THE RELATIONSHIP. This is the key. Can a team of highly skilled statisticians pick out terrorist calls? Probably, given enough historical data.

But it's also about what any plebeian idiot with a PC and some stats software can do, too. Anyone can add random variables and do cluster analysis until a bunch of known terrorist phone calls are grouped with you calling a bakery on a Thursday morning. Do you think some judge is like 'OK, show me the underlying correlation for these individual variables and that you tested each of these for statistically significant contribution to the model'. No, some hotshot is like 'lol I used SPSS and found terrorists!!!!' and they sign a warrant. In a sealed chamber because it was generated from a top secret program.

It's even WORSE than spying, because at least that is recording actual events. Here you get warrants from correlation, in a day and age where being suspected of certain crimes basically ruins your life and career. See rape/terrorism/embezzlement/etc.

Recent events (bank bailouts) have proven that we don't so much care about one of those three or at least prosecute. Maybe add terrorism as well if in the context of laundering money for them.
