Bunch of women-hating nerds in this thread. The lack of obvious resistance doesn't mean rape isn't occurring. And the involvement of alcohol doesn't automatically invalidate consent, but if someone is impaired and incoherent then it's sexual assault. If she was clearly wasted then he absolutely raped her.

Pretty much any sexual encounter is rape nowadays. Should strike DUI from the books as well, can't be held accountable for what you do when you've been drinking.

There's a lot of gray area in terms of consent and sexual assault and for that reason these types of cases are rarely prosecuted. If you're having oral sex in public and regretting it later on then you were probably blitzed out of your mind when it happened and I think any reasonable person would be able to make that distinction.
