In fact they did imagine it because a decent amount of them had been through religious persecution both from religious groups and secular ones. The methods matter not, in fact I bet if you did a minor amount of research you would see the number of dead from that persecution before they left England would eclipse the amount of dead from terrorism on our soils in the name of Allah. Three dead was a Wednesday night and not worthy of a manhunt.

As someone who has taught constitutional law for almost 40 years, I am ashamed it took me so long to see how bizarre all this is. Imagine that after careful study a government official - say, the president or one of the party leaders in Congress - reaches a considered judgment that a particular course of action is best for the country. Suddenly, someone bursts into the room with new information: a group of white propertied men who have been dead for two centuries, knew nothing of our present situation, acted illegally under existing law and thought it was fine to own slaves might have disagreed with this course of action. Is it even remotely rational that the official should change his or her mind because of this divination?

You have to charge the person. You can only hold them for 72 hours maximum (it's actually less than that but a Judge can extend it to 72) The Patriot act says anyone who is not American or is suspected of being a Terrorist (including citizens) can be held indefinitely. They have to have a lawyer present at all times if they request.

I could cite a lot of different shit, but not in the concise way you're looking for. Miranda didn't even exist until the 1960's. Etc.etc... Thought we'd have our many resident lawyers by now explain this.


edit: Also I noticed you and others saying "due process". Creating laws is a part of due process. You got your due process when you allowed your government to make the Laws and Acts of Congress, like the Patriot Act.

Yea, and only talking to liberals would they defend the "rights" of terrorists, and call the American citizen a stupid motherfucker for suggesting he doesn't receive the same rights as others.

This is stating they are invoking a clause from 1984, I just don't know which it is.

Authorities have not read the surviving Tsarnaev brother his Miranda rights, which include the right to remain silent and the right to an attorney. Federal law enforcement officials said they plan to use a public safety exception, outlined in a 1984 Supreme Court decision, "in order to question the suspect extensively about other potential explosive devices or accomplices and to gain critical intelligence."

I thought republicans had a massive hard on for the constitution and were all about their rights. Or are rights only important when they allow you to discriminate against minorities and possess dangerous weapons?

I'm not aware of any conservative Republicans who are overly concerned with making sure the Muslim terrorist gets a free lawyer, fair trial, Halal meals, his prayer time, a clean cell, a place to exercise, a copy of the Koran, phone privileges and excellent medical care. Thank god we have the liberals around to watch out for them though!
