Blackstone's formulation

All presumptive evidence of felony should be admitted cautiously; for the law holds it better that ten guilty persons escape, than that one innocent party suffer.

This variation was absorbed by the British legal system, becoming a maxim by the early 19th century.[9] It was also absorbed into American common law, cited repeatedly by that country's Founding Fathers, later becoming a standard drilled into law students all the way into the 21st century.[10]

Ben Franklin's version of Blackstone's Ratio is very commonly quoted
Other commentators have echoed the principle; Benjamin Franklin stated it as, "it is better 100 guilty Persons should escape than that one innocent Person should suffer".

I would rather guilty people go free than innocent people punished.
I agree completely, but the problem is that in a rape, in reality, both people are effectively on trial.

These are supposed to be hard questions.

Well that wasn't helpful.
Yeah, I'm sorry, considering people on this forum have actually killed themselves I shouldn't have said that.

Eat 4 pints of Ben and Jerry's instead. It works for McCheese.

Obtain a concealed carry permit (if required in your state), get some training, and if someone tries to stick something of theirs inside something of yours without your blessing shoot them until they reconsider.
No women are weak and incapable of such things, they must be protected like the puny little girls they are.

Well that is more considerate. Albeit not useful, unless your saying I've already fucked my chances.

Isn't it true that you're more likely to have the weapon turned against you?

Anyway, it's illegal to carry guns on my campus. Even the cops are forbidden by state law to carry guns (even though they're real cops that have the same training as all other cops in the state.) ROTC kids have to keep theirs locked up in the basement of the cop shop, the cops own no guns, and if guns are required they have to call in reinforcements from another jurisdiction.

Not if it's a gun and your trained and ready to use it, and willing to use it. Believe me I have a text book on how to disarm people with guns, guess how much I study that section. If you've got or can get an arm's length distance a gun wins.

Depends on the range the altercation starts. If you are already within arms reach it can be argued that a knife and/or some grappling training is better than a gun.

Regardless, I don't think 'carry a weapon into the bedroom' is a good message that will incentivize girls to feel safer and have more sex.

What I am saying is, that if you are raped, right now you have recourse. You can report it to the police and if there is evidence of it, the police will pursue it. We have thankfully gotten past the days where rapes were ignored or scoffed at.

However, if you are falsely accused of rape on college campuses atm, you are treated as guilty regardless of evidence. You have no recourse. Your career (as a professor or teacher) is done. As a student, you are most likely forced to drop out and if not will be harassed on campus.
Yeah, and there is a difference in which ones we "protect". Mist is using the false equivalence that "protecting" scumbag Steve, is the same as "protecting" scared Stacy. But even a moment of thought reveals this is a fallacy. "Protecting" Steve is a consequence of not getting involved, it's a naturally neutral position, in where Steve uses his own personal power to prey on people. Protecting Stacy involves us getting involved, it involves US (The people) giving Stacy power.

The difference is, if Steve does something wrong; all we are guilty of is not protecting Stacy from him. If Stacy ends up smashing an innocent guy? Then what we are guilty of is not only not protecting said guy, but ALSO grantimg Stacey the power to do what she did. In one case we FAILED tostopa problem. In the other case weCAUSEDthe problem.

This is why EVERY crime in treated this way. Because it's better for the state to be at fault through failing to act, then it is for the state to be at fault pressing it's huge amount of resources on someone by mistake. It's the essence of negative vs positive ill effect. It's why you let 10 guilty people go, rather than lock up one innocent person. Because the 10 guilty people? The culpability for them being bad is on them. That one innocent man? Well, the culpability is onus.

Meh, I keep a crowbar under my bed and have a few years of grappling under my belt.

I feel pretty safe from being raped.

I dunno it probably would, there might be a lot of dead guys at the end of the night, and maybe they didn't deserve it.

But fuck I might rather be shot stone dead than be falsely accused of rape, at least if I'm dead it would matter less.
