Alright, let's talk legal then. Believe it or not, consent can't legally be given when drunk. Fuck a drunk person, and it's entirely up to them to decide whether or not they've been raped. Yes, it's up to them to decide whether or not you've committed a crime and they've got the law on their side. You can't defend yourself in court by saying "But she said yes when she was drunk! According tome, that's not rape!" and walk out of the courtroom. You may not like it but yes, the examples I gave are pretty equivalent in that theybothfall into "grey zones".
I repeat:
Girls, if you don't wanna get raped, don't drink around guys.
Guys, if you don't wanna be accused of rape, don't fuck drunk girls.

The vast majority of alcohol-fueled sexual encounters are pleasant for both parties involved, because in most cases both sides act like responsible adults who know what they're doing. Actually they don't and you're fucking stupid. If the girl admits that she consented (albeit drunk), then thats NOT FUCKING RAPE. IN ANY COURT. The only time consent wouldn't be valid (or lack of objection, more to the point) would be when they are so drunk that they are practically unconscious.
I'll grant you that chicks scream rape at anything and everything, but if you can find me some case law saying "drunk = no consent" then I'm with you. Until then, shut the fuck up you fucking imbecilic twat.

If someone who's drunk tells you they're fine and is about to go get in their car, do you take their keys and call them a cab or do you let them go on their merry way? They're an adult after all, and they said they're fine. They're not of the right mind to make that call though, just like someone who's drunk isn't in the right mind to give consent for sexy time. Invalid or no consent? Probably rape. As for how drunk one would have to be for that to apply, I have no idea. How someone's supposed to tell if another person's too drunk to consent, I have no idea there either. Some chick getting slightly buzzed and deciding to let the whole football team run a train on her and regretting it the next day? Yeah, probably not rape. Obviously, it's not that cut and dry, but I don't think it's too much of a stretch to say that someone can be intoxicated enough while still being conscious to not be able to give proper consent. At the same time, I wouldn't say it's really someone's fault if a drunk person initiates with them. Again, how does one tell for sure whether someone's able to consent or not. Maybe someone can make a breathalyzer app for that!
So...I should start breathalyzing womenfolk before we touch parts? Like what BAC we talking, drunk driving limit? I should work up some sort of boilerplate waver/contract and keep a notary on standby.
