Looks like she's calling up the prosecution on the child abuse needing a condition of "intentional" which she is concerned about. She might have realized that shit was just beyond obscene and started to second guess that decision.

Obama needs to stfu. He never should have said anything. He's the President of the United States, not a pundit of Florida's justice system. Even saying "Everyone calm the fuck down" would be too much interest. He should pretend as if he's got WAY BIGGER fucking things to deal with. Like NSA, Economy, Foreign Policy, etc..etc... Not this American Idol bullshit.

West was pissed that at 0730 this morning the prosecution decided to email him that they were charging GZ with 3rd degree felony murder - Child Abuse. The judge and West went back and forth about it. The defense got a pretty good victory that the state can't include a special instruction about "Great bodily harm...not trivial injury..." Which is good for the defense and it sounds like the judge is not going to grant the murder 3 charge.

So Zimmerman chooses not to testify regarding 2nd degree murder charges, and now the judge has the ability to completely change the landscape of the deliberation... and the defense doesn't get an opportunity to defend against new charges.

this judge should be arrested.

To prove the crime of Third Degree Felony Murder, the State must prove the following three elements beyond a reasonable doubt:

1. (Victim) is dead.

Give 2a, 2b, or 2c as applicable.
2. a. [The death occurred as a consequence of and while (defendant) was engaged in the commission of (crime alleged).]

b. [The death occurred as a consequence of and while (defendant) was attempting to commit (crime alleged).]

c. [The death occurred as a consequence of and while (defendant), or an accomplice, was escaping from the immediate scene of (crime alleged).]

Give 3a if defendant actual perpetrator.
3. a. [(Defendant) was the person who actually killed (victim).]

Give 3b if defendant not actual perpetrator.
b. [(Victim) was killed by a person other than (defendant); but both (defendant) and the person who killed (victim) were principals in the commission of (crime alleged).]


Reading that it seems to me this charge would be used to charge someone who accidentally killed a kid, say some kid assaults some other kid and accidentally kills them, like a freak punch causes a brain aneurysm, IE aggravated assault. The prosecution is saying child abuse, but that seems to me to be reaching.

Watching this I am genuinely fearful of ever having any involvement of any kind in a high profile case such as this one. The way the courts operate is frightful. The prosecution spends the entire trial talking about one thing, they went over the charges they are seeking yesterday, and then this morning they sudden throw on this ridiculous felony murder charge with fifteen pieces of case law to support it. Well fuck guys, how long was this being worked on? Was this the backup plan all along provide the trial went poorly?

It's like I'm watching an adaptation of a John Grisham novel.

Yeah, this. So much ridiculousness, from not allowing text messages because a 7 year old might hack, to trying to charge child abuse when a 17year old is shot, just absurd.
