Felony murder is almost always bullshit. You should read some of the more outlandish cases.

One in law school we read, guy and his bro are robbing a jewelry store, cops show up, guy surrenders, gets handcuffed, put in the back of cop car. Bro runs, foot chase etc etc, pulls gun on cops, cops and shoot and kill him. They charge the guy sitting in the back of the cop car with felony murder, he is convicted, life in prison.

In this case though, the child abuse as a predicate to felony murder is just stupid because it obviously wasn't child abuse and the jury would not have found the predicate true. If the judge had let it in it would have just been a scattershot chewbacca attack hoping to confuse the jury and give them some kind of option to check the box.

Any death that happens in the commission of a felony makes you liable for felony murder.

Another guy got charged with felony murder from a street race where the one guy crashed and died. They charged the other guy with reckless driving to make it a felony and bootstrapped it up to felony murder.

Even when the COPS shoot the guy, he still died in commission of the crime.

Felony murder can be some serious bullshit.

I love it when the closing arguments start and right away, you can tell the whole thrust of their arguments are going to be in direct contravention of the evidence. The jurors should be thinking "wait, no fault of his own? Didn't he beat the crap out of the other guy?" lol
