Sure most people freeze, but do all? Not remotely. Additionally freezing at the sight of a gun is a response to it being BRANDISHED not other possible variants - like moving your coat back to show it as a hint. True fight or flight isn't rare if someone is threatening you that has a gun and doesn't have it pulled yet.

I have no idea where you went with that. There are people in jail though, who were attacked without provocation, used deadly force to defend themselves adn then were convicted. It is fairly rare, but it happens.
