Besides, your narrative doesn't fit the facts. They were not even "boyfriend and girlfriend". They were casually seeing each other and hooking up. She had to message him on facebook to talk to him. Her messages afterwards sure didn't suggest some culpability. She could have said, "sorry for my behavior that caused you to choke and rape me, I know thats not your fault. I'm down for more later." But she messaged like NOTHING happened.
Obvious conclusion? NOTHING HAPPENED.

You'd still have some arguments about what constitutes incapacitation, but it'd clear a whole lot of things up.
