As far as we can tell from anthropology and evolutionary psychology, men have likely always abhored rape under normal circumstances (by normal I mean when not raping the dehumanized enemy's women.)

Not on criminal court. Regarding your comments on contract, Cad already explained to you the difference and also contracts are civil law, not criminal law. Also as a side point, there is nothing criminal about breaking a contract, not in the USA.

Regarding my hypothetical

He has my consent at that time to smash my windows, that is not in doubt. My own words are his defense, so no one will charge my buddy under that. Remember I was not coerced to make my decision. I willing fully consumed the alcohol well aware of it effects on the human body and mind. Why is my buddy responsible for my actions? The only thing i am guilty of is making bad decisions.
