Disney doesn't get the rights back just because the movie flopped, they only get the rights back if Fox gives up on the IP. Seeing as how they held onto it for 8 years after the first two, I wouldn't expect Marvel to be getting it back any time soon, if ever. Eh... It was intended to make money plain and simple. They aren't going to run a mainstream movie into the ground just to hold onto the rights. Fantastic four 2 bombed so bad they scrapped the sequal and had to wait a decade for the heat to die off enough to get ANY traction.Yeah flop or not, this movie did was it was intended to do; retain the rights to the IP for Fox. The success of their X-Men movies will probably keep them inclined to thinking they will eventually get it right with F4.

yes, and it still forced the studio to abandon the planned sequal. it did something like $290 million at the box office... do we think that this new one is going to reach that much? the studio is ONLY going to hold on to ANY IP for as long as they believe it can make money. sure, the budget on the new one was about $125 million, and they'll get that money back at some point. the question is whether or not the studio believes it's worth it to hold on to an ip that is only bringing them in a small percentage in return instead of producing a different ip in it's place that could potentially bring in much more money.Rise of the Silver Surfer only did slightly worse financially than the original and received better ratings.
Our best hope is that they abandon it like Daredevil was abandoned, and then the rights revert back in like-so fashion. Look at how Disney did with Daredevil.yes, and it still forced the studio to abandon the planned sequal.
Perhaps, but at this point it costs them exactly zero dollars (from what I have been lead to understand) to hold onto it for whatever the requisite time is. I've been seeing 8 years thrown about, so unless they do a team-up like Sony, they might as well let it sit and be forgotten for awhile. Who knows what happens to Marvel movies, and the superhero genre in general, in 8 years? It costs them nothing to wait, but gives Marvel a huge bonus if they just turn it over now, so they won't.
