1. When calculating child support, is it based off the money I generate in a month, or a full time employments worth of hours? To clarify, I work 280+ hours a month, and am paid hourly.

2. Does child support include private school, etc. For example, if I owed $3000/month, and wife wants child to goto private school at 1000/month, how does that work?

In terms of what you’ll pay the state will go off your hourly wages if you work full-time so calculated as a 40 hour work week. Overtime, commissions and things of that nature are not considered guaranteed income so they don’t usually get factored into what you’re paying for child support. Also what she makes factors in as well, each state usually online child support calculator where it will calculate your income and your exes and then figure out on average what you will be paying in child support. Usually it’s pretty accurate unless they’re outside factors such as stipulations in your divorce and custody agreement that would influence that child support payment.

As far as private school goes unless otherwise stipulated in the agreement, that child support goes to paying everything in terms of supporting that child. In my first divorce I was not obligated to help pay for daycare costs because it wasn’t stipulated and the court told my ex that she had to use my child support payments to pay for that. However, when my second marriage ended it was stipulated that I had to pay for half of summer child support on top of my normal child support payment. At the end of the day what its going to come down to is the agreement that you guys have on paper.

The norm is they would factor in your rate of pay from your highest paying job. An exception could be made though if you've worked both jobs for 10 years and its a standard income for you then there's a chance it can be included. However, it's still fairly rare.

At the end of the day, consult your lawyer. If you don't have one, stop wasting time by posting here and go get one. That should always be your first move.

When I went through my 2nd divorce they factored in my other child obligation costs into the support.It didn't impact it much, but they still do that for you at least. I only had to pay for a short time until I got custody of him.
