That would seem to indicate that Marvel has the intention (and rights) of introducing SWORD at some point in the MCU. I would think FOX doesn't automatically get the rights of anything introduced in the X-Men comics in perpetuity (unless it falls under the "mutant" umbrella).
FOX pretty much has carte blanche to anything pertaining to "mutants", so I don't think it's necessarily a matter of that Marvel couldn't use any new characters introduced in X-Men, but that they'd never be able to ever use them fully since they are prohibited from making any mention of anything related to the X-Men or mutants in general.
