The best thing about Obamacare for me is it's finally incentivized me to get my W4 straight and not get a tax refund so I don't have to pay a fine for not having insurance!

Supposedly its going to appear on 1040ez forms so I'd be shocked if it would be avoidable by not filing. (Plus your income has to be pretty low to not file - over something relatively low ($45k I want to say) you're required to file even if you have bullseyed your projected taxes)

What he's talking about it not having a tax refund for the IRS to deduct the uninsured penalty from. He'd still file of course.

Wouldn't that just lead to them attaching his paycheck instead? I'm pretty sure the IRS has plenty of tools to come after people they want money from.

Indeed in HR there were dozens of things I'd see them go after a paycheck for - child support being the most common, but basically whenever I thought I'd seen the full list that could be garnished another would pop up.

I understood fully his concept just pretty sure it doesn't work - doesn't for any otherppenalties I'm aware of.

The ACA itself prohibits the IRS from using traditional means of collecting fines and back-taxes with respect to the uninsured penalty. The only avenue they are able to pursue under the law is garnishing tax refunds.

Dunno, I've had people read EIC that way and I've had employees that didn't qualify under such and still got it.

Unfortunately that aspect doesn't seem publicly documented. But tax penalties historically can't be dodged such ways.

Even if it works for now, it would not surprise me to see them change that aspect of it, sort of defeats the entire purpose if you can just change your withholding ensuring you owe and never get a refund. Now, they do not get to use that money before they refund it and they cannot collect on the health care penalty. Seems like too easy of an out to me.

I've seen it mentioned several times in the past. Here's one from theWashington Post:

While the government can collect the penalty by counting it against a person?s federal tax rebate, it will be barred from using other collection tools such as placing liens or threatening incarceration.

I would also expect it to be changed if it became a trend. And if that happens, then the penalty for every year it was assessed will be subject to the full toolbox of collection measures. I think they have up to 10 years to collect the penalty.

If republicans truly wanted to stick it to Obama and the democratic party and want to be considered a viable party in this country all they would have to do is push for Single Payer. Force democrats to prove they are who they say they are and ride the Single Payer system all the way to the White House.

This is why all they've done for the past four years is try to repeal with no mention of what they would replace it with.

Yep.

Penalties and fines will still apply. So they will get the money eventually. Even if you are in the right, it is rare to win against the IRS.

They could come out and admit their mistakes and say they are trying to move the country forward, the American people love them a good redemption story.

That's what the whole "re-branding" was supposed to be about, the real conservatives and career politicians wanted to course-correct, but the teahadists have infected too much of the party and contributed enormous negative publicity to the effort.

Even if they could, espousing a government based solution to anything that doesn't involve outlawing abortion, keeping foreigners out of the country, or national defense just isn't in their DNA. It's like saying a lion can cut out the middle wildebeest and start eating grass, if it wanted to.
